These Website Terms of Use govern your use of this website. By using this website, you agree to these terms.
2. Use of the website
You may use this website only for lawful purposes. You must not:
- misuse, disrupt, damage, or interfere with the site or its security;
- attempt unauthorised access to the site, accounts, servers, or related systems;
- scrape, data-mine, harvest, copy, or systematically extract content or data from the site without written permission;
- upload or transmit viruses, malware, or harmful code;
- use the site for fraud or attempted fraud;
- send abusive, threatening, defamatory, or otherwise unlawful messages;
- upload or submit material that infringes another person’s intellectual property rights.
We may suspend, restrict, or block access to the site or individual accounts where we reasonably believe these terms have been breached.
3. Intellectual property
Unless otherwise stated, all content on this website, including artwork images, text, branding, design, and other materials, is owned by or licensed to Emily Pyle and is protected by intellectual property laws.
No content from this site may be copied, reproduced, distributed, adapted, published, stored, scraped, or used commercially without prior written permission.
Purchasing a physical artwork does not transfer copyright or any commercial reproduction rights unless expressly agreed in writing.
4. Accuracy of information
We try to keep the website and its content accurate and up to date, but we do not guarantee that all information will always be complete, accurate, or current. Images, colours, and descriptions may vary depending on screens, photography, and the handmade nature of the work.
5. Availability
We do not guarantee that the website, or any part of it, will always be available, uninterrupted, or error-free. We may suspend, withdraw, or change all or part of the site without notice.
6. Links and third-party services
This website may rely on or interact with third-party services, such as payment providers or hosting providers. We are not responsible for the content or policies of third-party sites or services beyond our control.
7. Liability
Nothing in these terms excludes or limits liability where it would be unlawful to do so.
To the fullest extent permitted by law, we exclude liability for indirect or consequential loss arising from use of the website. These website terms do not limit any rights you may have under consumer law in relation to goods purchased from us.
8. Governing law
These terms are governed by the laws of England and Wales. The courts of England and Wales will have jurisdiction, except where mandatory consumer law provides otherwise.
Shop Terms and Conditions
These Shop Terms and Conditions apply to purchases made through this website, including original artworks, prints, and commissioned work.
2. Products
We offer:
- original artworks;
- prints;
- commissioned artworks;
- optional mounting for certain paper originals, where stated.
All products are subject to availability. Because original artworks are unique, stock errors may occasionally occur despite our efforts to keep listings current.
3. Prices
All prices are shown in GBP.
We are not currently VAT-registered.
Prices do not necessarily include customs duties, import taxes, or similar charges that may apply in the destination country. The customer is responsible for such charges unless expressly stated otherwise.
4. Orders
Placing an order does not mean it has been accepted.
An order is accepted only when we send a confirmation or dispatch email or notification.
We reserve the right to refuse, cancel, or limit any order before acceptance for reasons including pricing errors, suspected fraud, service restrictions, stock issues, or destination restrictions.
If we cancel an order before acceptance and payment has already been taken, we will refund the amount paid.
5. Payment
Payments are processed securely through Stripe. Available payment methods will be shown at checkout.
We do not store full card details.
Ownership of goods does not pass to the customer until the full price due has been paid.
6. Delivery
We dispatch ready-made artworks within 3 days of acceptance unless otherwise stated.
Estimated delivery times are estimates only and are not guaranteed.
We ship to the UK and selected international destinations. We may decline or cancel orders to destinations affected by sanctions, carrier restrictions, legal restrictions, or service disruption.
We use Royal Mail services and may use Parcelforce where relevant.
Risk in goods passes to the customer when the goods are delivered to the customer or a person identified by the customer to take possession of them.
7. International orders
For international orders, the customer is responsible for customs duties, import taxes, and any related charges that are not included at checkout.
Delays caused by customs or local delivery systems are outside our control.
8. Originals and prints: cancellation and returns
This section applies to standard ready-made items such as original artworks and prints purchased at a distance.
You have the right to cancel your order within 14 days after the day you receive the goods.
To exercise the right to cancel, you must clearly inform us by email at support@playtimelyre.com before the 14-day cancellation period expires.
You must send the goods back within 14 days of telling us you are cancelling.
You are responsible for the direct cost of returning non-faulty items.
Returned items must be packaged appropriately to avoid damage in transit.
If you cancel in time and return the goods as required, we will refund:
- the price paid for the goods.
- the basic outbound delivery cost originally paid, if any.
If you chose a delivery option more expensive than our standard delivery option, we do not have to refund the extra amount paid for that upgraded service.
We may reduce a refund if the value of the goods has been diminished by handling beyond what is necessary to establish their nature, characteristics, and functioning.
Refunds will be processed within 14 days of receiving the returned goods or receiving evidence that they have been sent back, whichever is earlier under applicable law. We aim to process qualifying refunds more quickly where possible.
9. Commissions
Commissioned artworks are personalised items made to the customer’s specifications.
Commission work begins only after the brief has been agreed and any required deposit has been paid.
The remaining balance for a commission is due before dispatch.
Because commissioned work is personalised, the standard 14-day cancellation right does not apply once the commission contract is agreed and work has begun, except where required by law.
Unless we agree otherwise in writing, if a commission is cancelled after work has begun, the deposit is non-refundable and there is no obligation to pay any further amount.
We may refuse a commission request at our discretion before accepting it.
We may also cancel or decline to continue a commission in exceptional circumstances. If we do so after acceptance and before completion, we will deal with any refund fairly and in accordance with the circumstances and applicable law.
10. Commission process
Customers must provide enough information for us to understand the requested work, including any relevant reference images and delivery details.
By sending reference images or other materials, the customer confirms that they have the right to provide and use those materials for the commission.
Revisions are dealt with on a case-by-case basis. Unless otherwise agreed, at least one revision opportunity may be offered, but the artist reserves the right to refuse further revisions. If further revisions are refused, the customer may either accept the work as finished or close the commission, in which case the deposit remains non-refundable.
Questions of whether a requested change is a revision or a new brief are determined at the artist’s reasonable discretion.
Estimated completion times are estimates only.
If the customer does not respond to a request for approval or input within one month, they lose the right to further revision on that stage of the work. In that event, the work may be treated as complete or reserved for the customer for up to one year from that point. If it remains unpaid and uncollected after that period, ownership of the physical work may revert to the artist, without transfer of copyright at any point unless expressly agreed in writing.
The commissioned work is considered complete when the customer accepts it as finished, or where the process above provides otherwise.
Progress updates may be provided on request, at the artist’s discretion.
Because original and handmade works are created by hand, reasonable variation may occur between sketches, previews, screen images, and the finished piece.
11. Mounting option
Where offered, mounting for certain paper originals is an optional add-on charged at the stated price.
12. Faulty, damaged, or incorrect items
Nothing in these terms affects your statutory rights.
If goods arrive faulty, damaged, or not as described, please contact us at support@playtimelyre.com as soon as possible and in any event within 30 days if you wish to rely on the short-term right to reject where available.
We handle faults, transit damage, replacements, substitutions, and refunds on a case-by-case basis in line with applicable consumer law and the nature of the item.
For prints, a replacement or refund may be offered where appropriate.
For originals, where appropriate and agreed, we may offer a refund, repair, or a substitute of equivalent value where that is a suitable and lawful resolution.
13. Lost parcels
If an order has not arrived, contact us at support@playtimelyre.com. We will investigate in line with the shipping service used and applicable consumer law.
14. Contact and complaints
Questions, complaints, and cancellation notices should be sent to support@playtimelyre.com.
We aim to respond to complaints within 5 business days and to resolve issues amicably wherever possible, whether by refund, replacement, repair, or another appropriate solution.
15. Intellectual property
All copyright and other intellectual property rights in artworks remain with the artist unless expressly assigned in writing.
Buying a physical artwork does not transfer copyright or any right to reproduce, distribute, adapt, mint, commercialise, or otherwise exploit the artwork.
Customers are welcome to share photographs of purchased works for personal, non-commercial purposes.
Unless agreed otherwise, we may display or refer to sold or commissioned works in the artist’s portfolio, social media, or promotional materials, unless the customer asks us not to.
16. Governing law
These terms are governed by the laws of England and Wales. The courts of England and Wales will have jurisdiction, except where mandatory consumer law provides otherwise.
